Mr.A.Natarajan, Senior Advocate, Madras High Court, clarifies the various allegations against GoldQuest and its marketing arm QuestNet in India.
"Authorities in Chennai have acted upon a complaint by an individual, without verifying the company's business plan, its policies and procedures or understanding its compensation plan. This has fuelled various negative media reports, many of which are factually incorrect and has irregularly caused and led to panic among the public. The company wishes to reiterate that it does not run an 'investment scheme' as suggested by various media reports."
MLM Business Model
Multilevel marketing is a legitimate business opportunity that allows individuals to earn an income that is commensurate with their efforts. This is not a "get-rich-quick" or "quick and easy money" scheme. Through its marketing arm, QuestNet India, a wide variety of products such as commemorative medallions, watches and vacation packages are retailed and every customer purchasing a product can avail themselves of a business opportunity to become an independent business representative (IR).
IRs are introduced to the company's products, services and business plan by other IRs who have availed of this opportunity. The company holds intensive training programs and business development sessions for customers wishing to benefit from the business opportunity where they are advised on the policies and procedures, the business model, the compensation plan, and the proper and ethical practices of building this business. IRs who take up the opportunity, in turn build their own teams where these sessions
are then conducted and are advised to emphasize that the opportunity involves running an independent business and is not an offer of employment and the company does not guarantee any income that is not commensurate with the time and effort put in by the IR.
Misrepresentation
Customers purchasing a product or availing the business opportunity are fully aware of the terms & conditions. Hence, the question of "inducement" or "cheating" does not arise to involve and implicate QuestNet India into a "criminal case". In instances of breach of policies and procedures where a group of individuals have been known to mislead or misrepresent the business plan to prospective customers for selfish gains, the company acts sternly on such breaches and does not countenance
any such breaches,
including suspending and terminating IRs who act improperly.
Compensation for complainants
The company would like to assure everyone that it will make arrangements to investigate all the complaints received by the authorities and all genuine and legitimate complaints will be settled. The company assures the public that it will give its full cooperation to the police and authorities to achieve this objective.
Delays in Delivery of Products
From May 2008, authorities in Tamilnadu have taken into custody all the products that we had in our storage, ready for shipment to customers, as part of their investigation. Due to this, we are unable to ship your products at this moment.
As we are making some progress on the legal front to prove our legitimacy, we are in the process of applying to the authorities for recovery of all property. Please rest assured that ALL products will be delivered as soon as this situation is resolved.
Company's Position
QuestNet India will defend all allegations against it in the Court of law and will be taking every means necessary to ensure reopening of its offices on an expedited basis to resume business operations.
